What Is a TRP?

A Temporary Resident Permit, issued under section 24 of the Immigration and Refugee Protection Act, authorizes a person who is otherwise inadmissible to Canada to enter or remain for a specified purpose and limited time. Unlike Criminal Rehabilitation (which is permanent), a TRP is temporary — typically valid 1 day to 3 years, with most issued for 1–6 months matching the specific travel need.

TRPs are discretionary. The Minister’s delegate (CBSA officer at the border, or IRCC visa officer abroad) must be satisfied that the applicant’s “need to enter Canada” outweighs the “risk to Canadian society” — the classic A24(1) IRPA balancing test.

When You Need a TRP

You need a TRP if all four conditions apply:

  • You have an existing ground of inadmissibility (criminal record, prior removal, misrepresentation, medical, security, etc.)
  • You need to enter or remain in Canada for a specific reason
  • You are not yet eligible for Criminal Rehabilitation (less than 5 years since sentence completion) OR Criminal Rehabilitation is pending
  • The need to travel cannot wait for permanent cure

Step-by-Step: How to Apply for an Overseas TRP

Step 1 — Confirm the Inadmissibility

Identify the precise A35/A36/A37/A40 ground. For criminal inadmissibility, prepare equivalency analysis comparing the foreign offence to a Canadian Criminal Code provision.

Step 2 — Define the Specific Trip

TRP applications must articulate exactly: dates of intended entry, purpose, duration, host or sponsoring party, accommodations, and reason for inability to delay until Criminal Rehabilitation eligibility. Vague “I want to visit Canada” applications are routinely refused.

Step 3 — Document Compelling Need

The strongest TRP applications demonstrate extraordinary need. Categories that consistently succeed:

  • Immediate family in Canada with serious illness, with hospital letters
  • Wedding, funeral, or birth of immediate family member, with documentary proof
  • Court appearance in Canada (subpoena, court date)
  • Business meetings tied to specific Canadian contracts or employment with employer letter
  • Medical treatment unavailable in country of residence (specialist referral)
  • Academic conferences with confirmed speaker/presenter invitation

Step 4 — Document Low Risk to Canadian Society

Evidence package:

  • Police certificates from all countries of residence (clean since the underlying offence)
  • Treatment program completion (AA, SMART Recovery, court-ordered programs)
  • Stable employment letters covering the period since the offence
  • Character references from employers, religious / community leaders
  • Tax returns demonstrating stable lifestyle
  • Time elapsed since the offence (the longer, the better)

Step 5 — Statement of Purpose + Reasons

Written submission addressing the A24(1) balancing test: why your specific need outweighs the residual risk. Cite supporting case law where applicable. We prepare these submissions for every TRP application.

Step 6 — File at the Correct Consulate

File at the Canadian visa office with jurisdiction over your current country of residence. Some consulates process TRPs significantly faster than others; we advise on jurisdiction-specific timelines.

Step 7 — Respond to Officer Questions

The officer may issue a procedural fairness letter or request additional documents. Tight 7–30 day deadlines apply.

Step 8 — Receive Decision

If approved: physical TRP document issued in passport. If refused: 60 day deadline to file Federal Court Application for Leave and Judicial Review.

Port-of-Entry TRP Strategy

POE TRPs are higher-risk but appropriate in three scenarios:

  1. Emergency family event — funeral or hospitalization that cannot wait for an overseas TRP processing window. Documented with hospital records, funeral arrangements.
  2. Brief business trip — 1–3 day meeting with a Canadian business partner, well-documented (signed contract, employer letter, conference registration).
  3. Low-complexity inadmissibility — single non-serious DUI, single non-serious theft 10+ years ago. Avoid POE for serious criminality (post-2018 DUI, fraud, drug trafficking).

Federal Court Judicial Review for TRP Refusals

Common reviewable errors in TRP refusals:

  • Officer treats inadmissibility as automatic disqualifier, fails to perform A24(1) balancing
  • Insufficient reasons — refusal recites the standard without engaging with the applicant’s specific evidence (Vavilov reasonableness review)
  • Officer ignores rehabilitation evidence or treatment completion
  • Procedural fairness breach — no PFL before relying on adverse credibility findings

The application deadline is 15 days (in-Canada applicants) or 60 days (outside Canada applicants) from receipt of refusal. Federal Court retainer: $10,000–$20,000 + $400/hour + 13% HST.

Frequently Asked Questions

How long is a TRP valid?

Anywhere from 1 day to 3 years, but most TRPs are issued for the specific duration of the travel need (e.g., 5 days for a wedding, 2 weeks for a business trip, 3 months for academic semester). The validity is at officer discretion.

Can I apply for multiple TRPs?

Yes. Many clients obtain repeated TRPs for ongoing needs (e.g., quarterly business trips) while waiting for Criminal Rehabilitation eligibility. Each application is decided on its own merits; prior approvals strengthen subsequent applications.

Can I work in Canada on a TRP?

A TRP alone does not authorize work. You need a separate work permit or open work permit. Some TRPs are issued in combination with work permits where the inadmissibility relates to the work context (e.g., a foreign worker with a minor criminal record).

Will applying for a TRP hurt my future immigration applications?

No — properly handled TRP applications create a record of acknowledged inadmissibility AND demonstrate rehabilitation efforts. They strengthen future Criminal Rehabilitation applications by showing IRCC has previously accepted the applicant for entry. A REFUSED TRP, however, may complicate future applications by creating a file flag.

My TRP application was refused. What now?

You have 15 days (in-Canada) or 60 days (outside Canada) to file Federal Court Application for Leave and Judicial Review. Yes — and this is the recommended strategy when you have urgent travel needs. The TRP bridges the 12-36 month Criminal Rehabilitation processing window. Once Criminal Rehabilitation is approved, you no longer need TRPs.
