Pathway Options

1. Canadian-Born via Surrogacy/IVF in Canada

Born in Canada = Canadian citizen by jus soli (Citizenship Act s. 3(1)(a)). Legal parentage establishment varies by province:

  • Ontario: Family Law Act 2017 — pre-conception agreement recognized
  • BC: Family Law Act 2013 — intended parents via pre-conception agreement

2. US Surrogacy

Common path for Chinese same-sex couples (CA, NV, IL). Born in US = US citizen. NOT automatic Canadian. Pathway: (a) dependent child sponsorship after parents PR; (b) citizenship by descent if at least one parent Canadian citizen at birth.

3. International Surrogacy

4. Adoption
