Legal Framework
IRPA s.96 — Convention Refugee
Person outside their country with well-founded fear of persecution on grounds of: race, religion, nationality, political opinion, or membership in a particular social group. SOGIE recognized as particular social group.
IRPA s.97 — Person in Need of Protection
Risk of torture, death, or cruel/inhuman treatment. Broader than s.96 (no Convention grounds required).
Claim Filing Process
- Initial filing (Inland CBSA or IRCC)
- Basis of Claim (BOC) — 15 days deadline
- Eligibility determination by IRCC
- RPD hearing 6-18 months
- Determination (positive or negative)
RPD Hearing
- Quasi-judicial Board adjudicator
- Closed hearing (not public)
- Claimant testifies under oath
- Country-condition evidence
- Witnesses may testify
- Counsel represents claimant
RAD Appeal (IRPA s.110)
Appeal grounds: error of law, mixed fact-law error, breach of natural justice. New evidence admissible if not reasonably available at RPD. ~30-40% appeals allowed.
Federal Court Judicial Review (IRPA s.72)
- 30 days from final decision
- Two-stage: Leave + Hearing
- Leave ~15-30% granted
- Hearing ~50-60% (of leave-granted)
- Remedy: set aside + remit
PRRA + H&C
PRRA: For those with removal order. ~5-10% approval (very low).
H&C (s.25): Discretionary PR. Kanthasamy framework: establishment, child best interests, country hardship. ~30-40% approval, 18-32 months.
SOGIE-Specific
IRCC Guideline 9: sexual orientation and gender identity recognized. Stereotype-based credibility prohibited. PRC SOGIE risk recognized as non-trivial in Canadian jurisprudence.
